Xometry strictly adheres to laws and regulations concerning export restrictions, including the International Traffic in Arms Regulations (“ITAR”) and the Export Administration Regulations (“EAR”). Clear and explicit language is important for any project with export restrictions to avoid project delays.
If ITAR/EAR is not selected at the time of the order and export restriction language is identified on the purchase order, drawing, or specifications:
- Xometry will pause any projects, regardless of manufacturing location.
- Staff will reach out to the customer to determine a resolution.
- When in doubt, Xometry will err on the side of caution and treat projects as ITAR.
Xometry cannot edit a customer’s technical drawing, and Xometry will not remove or redact and export restrictions or similar language. Any modifications must be done by the customer. Xometry will never source projects clearly identified as ITAR to non-ITAR suppliers. No exceptions.
Below are best practices for submitting a technical drawing with export restrictions.
Be Specific to Avoid Delays
Restrictive language that uses ambiguous phrases like “MAY,” “COULD,” or “OR,” should be avoided. For example, these generalized drawing statements do not define the actual export requirements of the product in the drawing and may require Xometry to ask you more questions about the parts or job:
THIS DOCUMENT MAY CONTAIN TECHNOLOGY OR TECHNICAL DATA REGULATED BY THE INTERNATIONAL TRAFFIC IN ARMS REGULATIONS OR EXPORT ADMINISTRATION REGULATIONS OR CONTROL OF UNCLASSIFIED INFORMATION REGULATIONS.
INFORMATION CONTAINED HEREIN MAY BE SUBJECT TO US LAWS AND US EXPORT CONTROLS UNDER INTERNATIONAL TRAFFIC IN ARMS REGULATIONS (ITAR) AND EXPORT ADMINISTRATION REGULATIONS (EAR). EXPORT OR RE-EXPORT MAY REQUIRE ADVANCE AUTHORIZATION FROM US GOVERNMENT.
We routinely see these wordings on technical prints. Such wording may cause a delay in sourcing and classification if projects are ordered without the customer notifying Xometry that the part is subject to ITAR or EAR.
What Xometry Needs in the Event of an Export Restriction Issue
Xometry will place a project on hold if ITAR/EAR is not selected and ambiguous export restriction language is present on the purchase order, drawing or specifications. We will request the following from a responsible stakeholder from the customer’s company:
- An email from the customer providing an Export Control Classification Number (ECCN) or stating that the project is not ITAR or otherwise export-controlled.
- If there is a sharing restriction such as “MAY REQUIRE ADVANCE AUTHORIZATION FROM US GOVERNMENT,” Xometry will require written consent to share this information with our supplier.
- ECCNs that are dual-use will require ITAR/EAR handling by Xometry.
EAR, CUI, and EAR99
